“non-human persons”

Dolphins: non-human persons? . . . Hasn’t this theme already been explored (semi-seriously) by science fiction writers?

What would it mean to have status on Earth as a non-human person? Any killing, hunting, or eating of dolphins would be illegal, certainly. Keeping them in aquariums and zoos for the viewing public would also be frowned upon. We couldn’t use them for military purposes – that is, unless we could do so with their consent. Doesn’t seem likely. Assuming the language barrier could ever be broken, I can’t imagine they’d be terribly patriotic toward many human causes. They probably wouldn’t – probably don’t - see things our way when it comes to our need to study them, experiment on them, etc. Even the act of granting dolphins status as something more than animals (as something a little closer to glorious us) might be seen as an example of human arrogance.

Wouldn’t their being recognized as ”non-human persons” mean that everyone would have to just leave dolphins alone?

    “Leaving dolphins alone” is pretty easy in the Central Interior of B.C. I am of the opinion that malls and theme parks shouldn’t have any. I also wonder if they are going the way of the wolf/dog. First, domesticate. Then, get them to work for us. Third, do tricks. Next, maybe bows in their non-existent hair, make-up. Etc. Dog-walking becomes dolphin swimming, a good job for New Yorkers out of work (if the water in the Hudson and the harbour are clean enough for survival). Carry a dolphin-bag for the refuse.

    Back to “leaving them alone.” Impossible to do in all but a few situations. We can’t let ringed seals alone; they absorb PCBs, other chemicals, from thousands of miles away. Inuit people suffer, too, from consuming the chemicals.

    I’d probably suggest something like this: Think about what ethical treatment of animals means in terms of your lifestyle and the beasties that live where you have your dwelling, or formerly lived. If dolphins are one of those, ask yourselves some hard questions. If you live in a cemented-over prairie, or a tamed-prairie wheatfield, ask yourselves some hard questions.

    I think you’re absolutely right, we can’t help having an impact on other living things when it comes to chemicals in the air and water and so on.

    And I HOPE you’re not right about dolphins’ “going the way of the dog,” as you say, but nothing would surprise me.
